Who Pays My Fees?
Contractors for the United States do not pay their own fees. Under U.S. Law the Employer and Insurance Company will pay your attorney’s fees and costs.
Fees include payments for all time spent working on your case, such as: drafting documents, attending hearings, client communications, appeals, mediations, and communications with the Employer’s counsel. Costs include any travel expenses for your attorney, all applicable filings, copying, and administration costs associated with your claim.
If you or someone you know was injured while working as a U.S. contractor, you have rights under U.S. Law. The law has a built in mechanism to ensure you have access to quality counsel by making the insurance companies and employers pay for the fees of the counsel you choose. If a counsel is asking you to pay any fees up front or indicates you should pay them out of a percentage of your recovery, they should be avoided at all costs.
